DWI and driving
Dallas driving without a license lawyer.

Driving without a valid license is usually a Class C ticket, but it can also mean an arrest, a towed car and, for someone without papers, a booking that immigration can see. The charge gets worse with prior cases or no insurance. We resolve the charge, clear any warrants and talk with you privately about the risks for you and your family.
Right now
If you were just stopped without a valid license.
- 01
Never give a false name or someone else's license
Giving false identity information to an officer is a separate crime, more serious than the ticket. Using fake documents is worse still. If it already happened, tell us.
- 02
Keep the citation and the court date
Ignoring it leads to a warrant and more charges. Bring the citation and any tow papers to your consultation.
- 03
Get the car out quickly
Storage fees add up every day. The owner usually needs proof of ownership and insurance, and a licensed driver has to drive it out.
- 04
If your license was only expired, renew it now
Renewing quickly can lead to a dismissal for a small fee. Keep the receipt and the new license for court.
- 05
If it was suspended, find out why
DPS lets you check your license status and what you owe online. Unpaid tickets, no insurance and old DWIs are common causes. We can help you clear them.
- 06
Talk to us privately
What you tell us stays between you and the firm. The consultation is free, in Spanish or English.

Texas law
How Texas treats driving without a valid license.
Texas separates having no license, carrying an expired one and driving while your license is suspended or revoked. The first two are usually fine-only tickets. Driving while license invalid is treated more seriously, and it climbs with prior convictions, no insurance or a crash.
| Offense | Range of punishment | Notes |
|---|---|---|
| No driver's license | Class C: fine up to $200 | Higher fines, and possible jail, with repeat convictions in a short period. |
| Expired license | Class C | Often dismissed if you renew promptly and pay a small fee. |
| Driving while license invalid (suspended or revoked) | Class C: fine up to $500 | The State must show the suspension was in effect and you knew about it or should have. |
| Driving while license invalid with a prior or with no insurance | Class B: up to 180 days in jail, fine up to $2,000 | Usually means an arrest at the stop. |
| Driving while license invalid with a crash causing serious injury or death | Class A: up to 1 year in jail, fine up to $4,000 | Can be charged alongside other offenses from the crash. |
| No insurance | $175 to $350 first; $350 to $1,000 after that | A conviction can also lead to a license suspension if you do not file SR-22 proof. |
| Giving a false name to an officer | Class B: up to 180 days in jail, fine up to $2,000 | More serious than the license ticket itself. |
A Texas license requires lawful presence
DPS asks for proof of citizenship or lawful presence before issuing a license. People with DACA, TPS, a work permit or a pending case may qualify. People without any status currently cannot get one in Texas.
Source: Tex. Transp. Code 521.142A ticket offense can still mean jail
The U.S. Supreme Court, in a case from Texas, held that police can make a full arrest even for a fine-only offense. Many officers write a ticket, but an arrest is possible, especially when there is no ID.

A second driving while license invalid charge, or one with no insurance, becomes a Class B misdemeanor with possible jail. Fixing the insurance and the license before court often changes the outcome.

Giving a fake name or date of birth to an officer who has detained or arrested you is a Class B misdemeanor. It also makes everything else harder to resolve.

How we handle a license case.
Mr. Estrada reviews the stop and your history and sets the plan. Our staff handles the court, DPS and insurance paperwork with him, and you get updates in English or Spanish.
01
Review the stop
We look at why you were stopped, how the officer confirmed your status and whether the car search and tow followed the rules. A bad stop can end the case.
02
Fix what can be fixed
Renewing an expired license, reinstating a suspended one, buying insurance and filing an SR-22 before court often leads to a dismissal or a lower charge.
03
Negotiate the charge
We push for deferred disposition, a reduction or a dismissal, and we avoid outcomes that count as a prior for the next stop.
04
Clear warrants and holds
If there are old tickets or a missed court date, we lift the warrants and the DPS holds so you are not arrested at the next stop.
05
Look at the whole picture
Before any plea, we consider how it could affect an immigration case, a job that requires driving or a pending license application.

Who handles it
The lawyer on the sign is the lawyer on your case.
Mr. Estrada has practiced in Texas since 2003, in state court and in the Northern, Eastern and Western federal districts of Texas. He reads the file and sets the strategy, with associates and staff who work the case alongside him. Everything is explained to you in English or Spanish.
What clients say
“Olegario firm made me feel like I was at home. As soon as I walked in the receptionist was very kind and professional.”Questions families ask us privately.
- Can this lead to deportation?
- A Class C license ticket by itself is generally not a deportable offense. The danger is the arrest: booking means fingerprints that federal agencies see, and since 2026 Texas officers can also arrest under the state illegal entry law (SB 4). Never carry or use fake documents.
- Can I ever get a license?
- It depends on your immigration status. DACA, TPS, a work permit or a pending residency case can make you eligible. Ask an immigration attorney about your options, and keep your criminal record clean while you wait.
- The car is in my spouse's name. Are they in trouble?
- Texas makes it an offense to knowingly let an unlicensed person drive your vehicle, and the owner's insurance may refuse a claim. We look at the owner's side too.
Dallas and Odessa
Where these cases go in Dallas and Odessa.
In Dallas, Class C license tickets from city police go to the Dallas Municipal Court downtown, and tickets from suburban cities go to their own municipal courts. Class B and Class A charges go to the county criminal courts at the Frank Crowley Courts Building. In Odessa, Class C cases go to the city's municipal court or an Ector County justice court, and higher charges to the Ector County courts. Our offices in Oak Cliff and Odessa handle both.
FAQ
Questions people ask.
Can I go to jail for driving without a license?
A first no-license ticket is fine-only, but you can still be arrested at the stop. Driving while license invalid with a prior or with no insurance is a Class B misdemeanor that carries up to 180 days in jail.
Can I drive in Texas with a license from Mexico?
A valid foreign license can work for visitors. People who live in Texas are expected to get a Texas license within 90 days of moving here, and officers often treat a resident with only a foreign license as unlicensed. The answer depends on your situation, so ask us.
Can I get a Texas license without papers?
Not at this time. Texas requires proof of citizenship or lawful presence. If you have DACA, TPS, a work permit or a pending immigration case, you may qualify.
My license was just expired. Is that a big deal?
Usually not. If you renew it soon after the ticket, the court can often dismiss the charge for a small fee. Do not ignore the court date while you wait.
They towed my car. How do I get it back?
Call the storage lot listed on the tow paperwork. The owner usually needs ID, proof of ownership and insurance, and a licensed driver must drive it out. Move quickly, because storage fees grow daily.
How much does it cost to hire you?
The first consultation is free and private. We discuss the fee and payment options up front, before you sign anything.
